The Law Office of Legal Advisor Piotr Pozniak LL.M. provides legal services related to litigation before common courts of all instances and before the Supreme Court. In addition, the Law Firm initiates and conducts, on behalf of its clients, enforcement proceedings to collect unpaid financial debts and provides services in the field of amicable settlement of disputes (mediation). The Law Firm's activities in the above-mentioned scopes relate to, among other things:
- conduct negotiations to reach a settlement to avoid a lawsuit
- Participate in negotiations aimed at reaching a settlement
- Represent clients before the competent court in conciliation proceedings
- Preparation and filing of a lawsuit (initiation and conduct of a lawsuit to award the benefit due)
- initiate enforcement proceedings to enforce a court-ordered amount due
- obtain a European Order for Payment (ENZ) to collect a debt due from a foreign counterparty
- taking action to obtain a European Enforcement Order (EEO)
The purpose of consensual dispute resolution (or mediation) is to work out a solution that satisfies the parties to the conflict, rather than to determine who is right. For this reason, mediation is used to alleviate or extinguish a dispute that exists between the parties, which is all the easier to achieve since the persons previously in conflict are equal partners in the conversation. This, in turn, significantly facilitates the search for a solution related to the existing dispute or conflict. Importantly - no one can impose on the parties how to resolve the dispute, as the parties themselves are responsible for the outcome of the mediation.
